Liberale doorns in het oog van Viktor Orbán? De jacht op Hongaarse NGO's.

Reeds in de vorige eeuw predikte de Hongaarse denker Bibó het ideaalbeeld van een democraat – een persoon die niet bang is van andere meningen. In het Hongarije van vandaag lijkt de omgekeerde beweging aan de gang: Viktor Orbán gaat de strijd aan met alle kritische stemmen binnen zijn samenleving. In het kader van het illiberaal project legt hij het vuur aan de schenen van ‘Brussel’, ‘de migrant’ en ‘de kritische media’. Het blijken allen volksvijanden te zijn. Ook het maatschappelijke middenveld, de ‘civil society’, die zich kritisch uit ten aanzien van het huidig beleid, moet aan banden gelegd worden.

Volksverraders

De state of the nation van 2017 betekende een nieuwe cesuur in de geschiedenis van aanvallen op de Hongaarse civiele maatschappij. Orbán noemde in de toespraak deze organisaties het transnationale imperium van György Soros, die met ‘zwaar geschut en grote sommen geld’ zijn tentakels op Hongarije vestigt. Daarenboven sprak hij in metaforische taal over migratie als een Hongaars paard van Troje dat migranten en terroristen in draf binnenloodst in ‘hun natie’.

LexNGO

De regering-Orbán werkte eind maart 2017 een wet uit –de LexNGO– voor buitenlandse gefinancierde organisaties zodat ze hun fondsen zouden moeten aangeven en hun organisatie als buitenlands gefinancierd moeten registreren. Begin april van dit jaar neemt Viktor Orbán de academische vrijheid in het vizier. Zonder voorafgaand debat stemt het Hongaarse parlement voor een wet die de liberale Centraal-Europese Universiteit (CEU) in Budapest kan ontbinden. Ondanks dagen van massale protesten en kritiek van intellectuelen, ondertekent ook de Hongaarse president kort daarop de wet. Verscheidene analisten roepen de EU op om iets te doen tegen de uitholling van de Europese vrijheden in Hongarije.

Drijfveren anti-NGO beleid

Mijn onderzoek gaat na of er een gewijzigde legitimiteit is van Hongaarse NGO's en welke factoren daartoe hebben bijgedragen. In eerste instantie is het regeringsdiscours, waar Viktor Orbán buitenlands gefinancierde NGO's afschrijft als 'natieverraders', schadelijk voor de publieke legitimiteit van de betreffende organisaties. Bovendien staat de politieke legitimiteit van de NGO's op de helling door de nieuw geïntroduceerde LexNGO die de werking van de organisaties wil ontbinden. Welke mechanismen er achter deze LexNGO zitten is de tweede rode draad van het onderzoek.

Politieke, institutionele, sociale en financiële factoren

Sinds 2010 behaalde Fidesz een tweederdemeerderheid in het Hongaarse politieke toneel. Dit politieke overwicht (en een zwakke oppositie) maken het de Hongaarse regering gemakkelijk om kritische stemmen in de samenleving waaronder de NGO’s te negeren of tegen te werken. Dit zet de Hongaarse regering ertoe aan de beleidssamenwerking te beknotten door zowel de politieke als sociale instellingen (CÖF) te centraliseren en te onderwerpen aan de Fidesz’ doctrine. Bovendien wordt de werking van de bevraagde NGO’s bemoeilijkt door hen financieel te benadelen, door bijvoorbeeld enkel subsidies te geven aan overheidsgezinde organisaties.

Uit het onderzoek blijkt dat vooral de ‘publieke sfeer functie’ wordt uitgehold. Op politiek vlak uit dit zich in het bestempelen van de NGO’s als ‘buitenlandse operatoren’ en het verwijt de oppositie te verstevigen. Op institutioneel vlak werden de fora stelselmatig gekortwiekt en de toegang tot publieke informatie bemoeilijkt. De financiële bevoordeling van gezagsgetrouwe organisaties met de daaropvolgende steun door buitenlandse donoren aan liberale NGO’s, heeft er mede voor gezorgd dat het illiberale discours van Orbán nog werd versterkt.

Zowel op sociaal als politiek vlak probeert de regering de macht van de NGO’s in te perken en de legitimiteit van de organisaties in twijfel te trekken. Dit proces kent een voorlopig orgelpunt in de LexNGO. Door daarenboven een stigmatisering en intimidatiecampagne op te starten, tracht de regering niet enkel hun legitimiteit en positie in de publieke sfeer te schaden, maar wordt ook hun durf op de proef gesteld. In dergelijke omstandigheden is een zekere vorm van zelfbescherming door de NGO’s om hun werking niet op het spel te zetten niet irreëel.

De ideologische strijd: antiliberalisme, de LexCEU en LexNGO

Uit het onderzoek blijkt dat de politieke, institutionele, sociale en financiële factoren een onvolledig beeld schetsen van het huidige politieke klimaat en regelgeving omtrent NGO's. Het antiliberalisme blijkt een stuwende kracht achter de maatregelen: in 2017 werden in een zeer kort tijdsbestek twee opmerkelijke wetten gestemd, de LexNGO en de LexCEU. Die laatste kan de sluiting van de CEU, de Centraal Europese universiteit in gang zetten. De CEU en liberale NGO's zijn de antithese van alles waar Orbán niet voor staat: vrijdenkende liberaal kritische organisaties. In beide gevallen gaat het om instanties door het buitenland worden gefinancierd en die kritisch staan ten opzichte van het Hongaarse beleid. Het zijn organisaties die een meer liberale koers varen en die niet passen in het illiberaal project van het Hongarije van Orbán – het zijn liberale doornen in het oog van Viktor Orbán.

Aanpassing strategieën

Hoe gaan de organisaties om met de nieuwe situatie? De meeste NGO's pasten hun strategieën aan en gaan van een directe naar indirecte vorm van democratie ondersteuning. Doordat de checks en balances afgekalfd zijn en de machtsverhoudingen veranderden in het Grondwettelijk Hof, vechten de organisaties bijvoorbeeld zaken aan bij lokale rechtbanken. Op die manier proberen ze als outsider ‘check’ van het systeem de constitutionele vrijheden en rechten te waarborgen.

De hervormingen stuitten ondertussen op publieke ontevredenheid. In Boedapest komen mensen massaal op straat. Dit kan een belangrijk signaal geven aan de Europese Unie om Hongarije niet te vergeten. Het onderzoek schuift tot slot de hypothese naar voren dat een informeel bottom-up democratiseringsproces geleid door NGO’s perspectieven biedt op her-democratisering.

Het onderzoek biedt een eerste inzicht in actuele gebeurtenissen in Hongarije en kan als pilot-study waardevol zijn voor toekomstig onderzoek. Bovendien toont de studie aan dat de Europese Unie zich de mond niet mag laten snoeren door illiberale krachten.
