Op welke afdeling hoor ik thuis chef? Een kritisch interpretatieve synthese over de classificatie van transgenders in de gevangenis.

Een onderzoek naar transpersonen in detentie.

We leven in een veranderende maatschappij, een maatschappij waar criminaliteit in alle lagen van de bevolking aanwezig is. Maar verandert de gevangenis mee op hetzelfde tempo als de maatschappij? Het antwoord is hier spijtig genoeg 'nee'. Het gevangeniswezen loopt achterop, ook in België.

Transpersonen in detentie
Als we kijken naar de bevolkingsgroep transpersonen in de maatschappij, dan zien wij positieve veranderingen. Als we deze personen belichten in de context van de gevangenis, dan zakt de moed ons in de schoenen. In de Belgische gevangenissen is er geen beleid terug te vinden, geen leidraad, geen wetenschappelijke literatuur voorhanden, we staan als het ware enkele decennia achterop ten aanzien van onze gemeenschap. Wegens deze achterstand, heb ik deze thesis geschreven. Mijn doel was om transpersonen in detentie te belichten en het gevangenisbeleid wakker te maken.

Op welke afdeling hoor ik thuis chef?
Een belangrijke factor voor transpersonen tijdens hun detentie is hun plaatsing.  Op welke afdeling worden ze geplaatst? Waarom worden ze daar geplaatst? Welke problemen zijn zo verwezen met de afdelingskeuze dat ze in rekening moeten gebracht worden bij de keuze? Belangrijke vragen met nog belangrijkere antwoorden. Er ontbreekt beleid rond deze keuze, essentieel beleid. In de huidige samenleving worden transpersonen vaak op basis van zijn/haar/hen geboortegeslacht geplaatst op een afdeling.

Om te bekomen tot antwoorden op bovenstaande vragen werd een onderzoek gevoerd doorheen de internationale wetenschappelijke literatuur en onderzoeken. Internationaal, aangezien in België de grote belichting nog in de toekomst ligt. De informatie vergaart uit verschillende delen van de wereld hadden één aspect met elkaar gemeen, er bestaat geen "perfecte" keuze qua afdeling. Elke plaatsingskeuze gaat gepaard met verschillende problemen, zoals mentale problematieken, discriminatie, geweld, misbruik, misgendering, enzovoort. 

Daarom is gestreefd naar de beste afdeling, hierbij werd rekening gehouden met alle aspecten tijdens detentie. Om de veiligheid van zowel cis- als transpersonen te waarborgen wordt vaak geopteerd voor een afzonderlijke afdeling voor transpersonen. Alsook is er de mogelijkheid voor transpersonen om gehuisvestigd te worden op de afdeling waar zij zich thuisvoelen. Rond deze thematiek is heel veel discussie, maar vooral een tekort aan gehoord worden.

Stof tot nadenken...
Dit onderzoek duidt het belang aan van een verandering van het gevangenisbeleid, het belang van die veranderende maatschappij, maar vooral hoe belangrijk het is dat elke persoon op een gelijkwaardige manier wordt behandeld, zelfs in detentie.
