Bij het therapeutisch werken kan het soms noodzakelijk zijn de geheimhoudingsplicht naast zich te laten liggen en een derde partij te betrekken. Dit is in het bijzonder het geval wanneer men met minderjarigen in risicovolle situaties werkt. De therapeut bevindt zich hierbij als het ware tussen twee vuren: langs de ene kant wil deze zo sterk mogelijk de geheimhouding bewaren, aangezien het onrechtmatig doorbreken hiervan wettelijk strafbaar is en er zonder wederzijds vertrouwen therapeutisch onmogelijk gewerkt kan worden. Maar langs de andere kant riskeert de therapeut dat het fout afloopt omdat niemand ingelicht werd wanneer er wel daadwerkelijk gevaar was. Dit noemen we schuldig verzuim, wat eveneens wettelijk strafbaar is. Maar wanneer spreken we van écht gevaar? En doorbreken therapeuten dan meteen het beroepsgeheim of gebeurt dit minder snel dan men zou verwachten?

The World Health Organisation (WHO) zet zich in voor onderzoek rond en optimalisatie van gezondheid wereldwijd. Volgens hun statistieken is suïcide de op 2 na grootste doodsoorzaak bij jongeren. De kaart hieronder toont de globale sterftes ten gevolge van zelfverwonding. Wanneer men hierbij ook weet dat verschillende studies een connectie tussen suïcide en zelfverwonding aantonen en dat er bij zelfverwonding maar gemiddeld 30% van de slachtoffers hulp zoekt, dan kan men begrijpen dat zelfverwonding als een risicovolle situatie gezien kan worden.

De studie
 

Jasper is een jongen van 14 jaar. De ouders van Jasper besloten hem elke woensdagnamiddag bij een therapeut te laten langsgaan omdat Jasper de laatste maanden somber en stil is geworden en omdat het minder goed gaat op school. Na enkele sessies vertelt Jasper dat hij vaak met een scheermes in zijn bovenarmen snijdt, maar dat zijn ouders dit helemaal niet mogen weten. Hoe sterk zou jij geneigd zijn als therapeut om de ouders toch op de hoogte te brengen?

In onze studie werden verschillende scenario’s zoals deze hierboven geschetst. Hierbij werden steeds drie variabelen gemanipuleerd: de leeftijd van de minderjarige (12/14/16), het geslacht van de minderjarige (M/V) en de wijze waarop de therapeut de zelfverwonding ontdekt (jongere vertelt therapeut/ therapeut ziet littekens/ therapeut heeft sterk vermoeden). Online werd dan bevraagd hoe sterk de participanten hierbij geneigd waren om de ouders in te lichten, ookal wil de minderjarige dit zelf niet. De vragenlijst werd zowel bij het algemene publiek als bij professionele zorgverleners afgenomen. Hierbij werd voorspeld dat hoe jonger de minderjarige was, hoe sterker men geneigd zou zijn de ouders te verwittigen. Ook verwachtten we dat het algemene publiek zou overschatten hoe snel men tegen het beroepsgeheim ingaat en informatie doorgeeft, terwijl professionele hulpverleners de informatie sterk bij zich zouden houden.
Uit de resultaten bleek inderdaad dat men het beroepsgeheim sneller doorbrak wanneer de minderjarige jonger was. Dit zagen we bij zowel het algemene publiek als bij de professionele zorgverleners. Het geslacht van de minderjarige zorgde niet voor significante verschillen. Wel vonden we terug dat men meer geneigd was het beroepsgeheim te bewaken wanneer de therapeut enkel een sterk vermoeden had, terwijl men nét minder hiertoe geneigd was wanneer de minderjarige zelf vertelde over de zelfverwonding. Hierna gebruikten we een wiskundige methode die onze data opdeelt in groepen die sterk op elkaar lijken. Na het toepassen van deze techniek werden drie verschillende groepen ontdekt: de deelnemers in groep 1 waren sterke voorstanders van het informeren van de ouders; terwijl de deelnemers in groep 3 hier nét resoluut tegen waren. De deelnemers in groep 2 bleven een beetje in het midden hangen en waren eerder neutraal. Nu, volgens onze hypothese zouden de professionele hulpverleners die deelnamen aan de studie zich in grote aantallen in groep 3 moeten bevinden. Wat we echter zagen was dat deze gelijk verspreid waren over alle drie de groepen met ongeveer evenveel voor, tegen of neutraal. Met andere woorden, er kon geen unanieme beslissing bij de professionele hulpverleners opgemerkt worden. Het is uiteraard waar dat ook hulpverleners gewoonweg mensen zijn die van elkaar verschillen in karakter en persoonlijkheid, maar een gelijke verdeling over alle drie de groepen toont toch een gebrek aan rechtlijnigheid binnen de behandeling. Het gaat hier inderdaad om complexe situaties die niet allemaal machinaal op dezelfde manier kunnen opgevangen worden, maar een iets uniformere aanpak met betrekking tot het beroepsgeheim zou zowel mogelijk als aangewezen kunnen zijn.  

 

Functional Measurement Theorie

Daarnaast werd bij het onderzoek gebruik gemaakt van een Functional Measurement perspectief. Deze psychologische theorie werd ontwikkeld door Norman H. Anderson en onderzoekt hoe personen verschillende informatiebronnen samen combineren om uiteindelijk tot één geïntegreerd besluit te komen. Anderson beschrijft daarbij drie mogelijke opties: mensen tellen de informatie op, ze vermenigvuldigen de info of ze nemen het gemiddelde. We onderzochten dit Functional Measurement perspectief en vonden dat participanten voornamelijk de informatie optelden. Dit betekent dat de variabelen elk in een bepaalde mate bijdroegen tot de neiging om het beroepsgeheim te doorbreken. Het verschil met vermenigvuldigen is dat bepaalde combinaties van de niveau’s van de variabelen ineens explosief hogere scores kunnen geven, terwijl bij het nemen van het gemiddelde bepaalde variabelen tegen elkaar kunnen opwegen. Weten dat deelnemers de informatie bij elkaar optellen kan belangrijk zijn indien men mensen meer of beter wil informeren. Wanneer men de informatie opteld wordt er bijvoorbeeld maar weinig aandacht besteedt aan het idee dat bepaalde variabelen elkaar kunnen compenseren, terwijl dit misschien wel nuttig kan zijn.

Naar een zachtere toekomst 

Hoewel de studie een eerder beperkt aantal deelnemers had en echte scenario’s meestal een heel stuk complexer zijn dan deze die in het onderzoek gebruikt werden, zou deze studie toch een eerste aanzet kunnen zijn om aan te tonen dat er mogelijks nog te veel onduidelijk rond de geheimhouding bij zelfverwondende jongeren. Door de manier waarop men beslissingen neemt rond het al dan niet doorbreken van het beroepsgeheim beter te begrijpen, zou men meer duidelijkheid en voorspelbaarheid kunnen scheppen en minderjarigen beter kunnen informeren. Hopelijk zouden deze veranderingen ervoor kunnen zorgen dat meer van deze jongeren in risicosituaties professionele hulp zullen opzoeken.
