België: dansen op een slappe koord

Sinds de zogenoemde lock down in Brussel (november 2015) is men ook in België beter

vertrouwd met het begrip ‘etnisch profileren’ – ook wel bekend als ‘raciaal profileren’ of

Engelstalige varianten. Verschillende mediatieke Vlamingen met een etnisch-andere

achtergrond beweerden toen zonder directe aanleiding te zijn geviseerd en gecontroleerd door

de politie. Ze kwamen naar voren als het te vaak gesarde, woedende en luidkeels roepende

topje van een grote, stille ijsberg van de etnische minderheden in België. De getuigenissen en

commentaren van bronnen binnen of nabij de politie deden stof opwaaien in klassieke en

sociale media, en dit in een periode waarin terrorismebestrijding en een ‘proactieve’ politie in

het middelpunt van de belangstelling stonden. Zijdelings werd ook verwezen naar het

‘gekende’ racisme binnen bepaalde politiecorpsen en de invloed van terreurdreiging op het

activeren van bestaande vooroordelen.

Nader onderzoek over etnisch profileren in België toont vooral geluiden van politici,

opiniemakers, ‘vermeende’ slachtoffers, (voormalige) politieambtenaren alsook

racismebestrijders. Het debat blijft dan ook steken bij het vermeende gebrek aan onderzoek,

cijfers, bewijzen en rechtspraak. Er is een uitgesproken nood om etnisch profileren in België te

kaderen, te begroten, te begrijpen en eventueel te bestrijden.

Laetitia Parmentier koos er in haar masterproef in de rechten voor om het voorkomen van

etnisch profileren te onderzoeken vanuit het recht op gelijke behandeling en non-discriminatie.

Het is immers bekend dat de Belgische wetgeving de strijd tegen discriminatie ernstig neemt.

De antiracisme- en antidiscriminatiewetten kennen althans een redelijk rijke geschiedenis. Maar

hoe zit het met de toepasbaarheid van de nationale wetten en het internationale kader (e.g. het

Europees Verdrag voor de Rechten van de Mens en het Unierecht) op de situaties die als

etnisch profileren worden geduid?

Een eerste (non-) vaststelling in dat onderzoek: er is nog geen eensluidende en juridische

definitie voor de praktijk van etnisch profileren. We begrijpen onder de noemer etnisch

profileren het gebruik van veralgemeningen over ‘ras’, huidskleur, etnische en nationale

afkomst en religie als aanwijzing voor verdenking bij de opsporing en rechtshandhaving, op

zowel operationeel als organisatorisch niveau, terwijl daarvoor geen objectieve rechtvaardiging

bestaat. Voor de Belgische context en het onderzoeksopzet bleek dit alvast de best bruikbare

en meest volledige omschrijving.

Op juridisch vlak bleek etnisch zeker in België maar een zwak beestje – veel

mensenrechtenrapporten, veel minder rechtsleer, nauwelijks rechtspraak en zoals gezegd nog

geen bestaan op niveau van een wet. Het kwam wel duidelijk naar voren dat etnisch profileren

een inbreuk vorm op het non-discriminatiebeginsel, wat bevestigd werd in enkele arresten van

internationale en nationale rechtshoven (buiten België). De complexiteit van het fenomeen van

etnisch profileren en de verwevenheid met andere (onderzoeks) domeinen leidde quasiautomatisch

tot literatuur uit sociologische en criminologische hoek, voor een scherper beeld op

etnisch profileren. Zo is er geen enkele aanwijzing dat etnische profielen gebruiken een positief

effect heeft op politiewerk én er bestaat ook geen objectieve rechtvaardiging voor de praktijk.

Het staat vast dat etnisch profileren op gespannen voet staat met meerdere mensenrechten, met

de beginselen van democratische politie en dat het zelfs contraproductief zou zijn.

De onderzoeker identificeerde vervolgens sterke argumenten voor het bestaan van een

probleem rond etnisch profileren in België, waartegenover binnen de politie nauwelijks actie of

zelfs bewustzijn bleek te bestaan. Qua onderzoek, juridische actie en (politieke) remediëring

van etnisch profileren loopt België achter in vergelijking met de meest nabije Europese landen.

In de masterproef werd dan ook aandacht besteed aan een mogelijke omgang met het probleem

in de context van België, via een korte peiling naar de visie van discriminatie-experts en

politieke actoren ter zake. Ook hieruit blijkt dat de nood aan onderzoek en

informatieverzameling bijzonder groot is. Onder politieofficieren i s e r weinig kennis van de

wetgeving en van het belang van anti-discriminatie; op politiek niveau is de actiebereidheid

minimaal. Bovendien komen ook in de aanpak van etnisch profileren gekende problemen van

de toepassing van de anti-discriminatiewetgeving bovendrijven: weinig bekende wetten,

daardoor niet geliefd en bovendien behept met de handicap van een haast onmogelijke

bewijsvoering.

In de aanbevelingen benadrukt Parmentier dat de benadering van het probleem etnisch

profileren vanuit het bestaande referentiekader rond discriminatie houdbaar is, maar niet zonder

meer. Met het oog op verder onderzoek én bewustmaking bij de politiekorpsen zelf kan best

worden ingezet op kleinschalige initiatieven om de bestaande praktijken en eventuele

vooroordelen in kaart te brengen. De link met de wetgeving in het kader van racisme en

discriminatie zou duidelijk moeten zijn, voor zowel de rechtshandhavers als de bevolking. De

criteria bij het nemen discretionaire beslissingen moeten steeds ernstig overwogen worden,

onder meer met het oog op het vermijden van het gebruik van etnische stereotypen. Dit is nog

essentiëler in een operationele context waarin de politie meer bevoegdheden en vrijheden krijgt

t.o.v. de burger. Daartoe is training en controle noodzakelijk; de rol van de korpsoversten is

navenant cruciaal.

Bovendien dient de schadelijke impact van de subtiele, vaak onbewuste praktijk van etnisch

profileren goed te worden verspreid: etnisch profileren zet de gelijke behandeling en andere

mensenrechten in politiewerk onder druk en zorgt voor een disproportionele focus op bepaalde

bevolkingsgroepen; deze stigmatisering heeft dan weer een nefast effect op sociale cohesie.

Etnisch profileren is een praktijk die de spanning tussen mensenrechten en rechtshandhaving op

scherp zet; de slappe koord waar de juridische strijd tegen discriminatie in België momenteel op

lijkt, moet strakker in de aanpak van etnisch profileren, en dit in het belang van alle

betrokkenen.
