Het op de markt brengen van genetisch gemodificeerde organismen in de Europese Unie en de Verenigde Staten

GGO’s in de Europese Unie en in de Verenigde Staten: een wereld van verschil

In 2014 werd op wereldvlak een oppervlakte van 181,5 miljoen hectaren gebruikt voor de teelt van  genetisch gemodificeerde gewassen. Deze oppervlakte stijgt jaarlijks met 3 tot 4%. De Verenigde Staten prijken op nummer één van de ranglijst wat betreft de teelt van GGO’s. In de Europese Unie daarentegen doet het begrip alleen al menig mens huiveren. Maar waarom zijn de meningen hierover zo uiteenlopend in de Europese Unie en in de Verenigde Staten? Waarom is het beleid over GGO’s zo verschillend tussen beide grootmachten?

Maar first things first. We hebben allemaal wel eens gehoord over genetisch gemodificeerde organismen, maar wat zijn ze eigenlijk? Hoewel dit zogenaamde Frankenstein-voedsel tot de verbeelding doet spreken, is het relatief eenvoudig uit te leggen. Het komt erop neer dat het erfelijk materiaal van een organisme gewijzigd wordt door een menselijke handeling. Zo kunnen bepaalde vitaminen of mineralen in een gewas aangebracht worden die niet aanwezig zijn in zijn “natuurlijke” vorm. De “gouden rijst” in Azië is daar een voorbeeld van. Het vitamine A tekort is in Azië een belangrijke oorzaak voor kindersterfte en ziekte. Men probeert dit te verhelpen door de samenstelling van de rijst te wijzigen en vitamine A toe te voegen. Het resultaat hiervan noemt men de “gouden rijst”. Deze verandering in het DNA kan onmogelijk gebeuren op een “natuurlijke” wijze, zoals bijvoorbeeld door de kruising van twee planten.

GGO’s worden ook gebruikt voor andere doeleinden, zoals geneesmiddelen. Deze scriptie beperkt zich echter tot het gebruik ervan in voedsel voor mens en dier.

Elke burger, waaronder u, komt in contact met GGO’s vanaf het moment dat hij genetisch gemodificeerd voedsel in de supermarkt kan kopen. Het GGO wordt op de markt gebracht en is vanaf dan niet meer enkel toegankelijk voor een select groepje van wetenschappers. In deze scriptie wordt de nadruk gelegd op de regulering van GGO’s vanaf het moment dat ze in de handel worden gebracht. Meer bepaald wordt onderzocht op welke manier en waarom de uitvoering van de regelgeving van de Europese Unie verschilt van die van de Verenigde Staten.

De Europese Unie koos ervoor nieuwe wetgeving in het leven te roepen, specifiek gericht op GGO’s. Het juridisch kader is zeer uitgebreid en complex. Zo zijn verschillende organen bevoegd binnen de EU, waaronder de Raad, het Europees Parlement en de Europese Commissie. Bovendien moet steeds rekening worden gehouden met de uiteenlopende visies van de verschillende lidstaten. Daarnaast is niet enkel de wetenschappelijke risicobeoordeling door de European Food Safety Authority van belang, maar spelen de socio-economische en ethische aspecten ook een rol. In het debat rond GGO’s mag evenmin de druk van de publieke opinie uit het oog verloren worden.

In de VS daarentegen worden GGO’s gereguleerd in het kader van reeds bestaande productgerichte wetgeving. De drie agentschappen die daarbij bevoegd zijn, zijn evenmin nieuw. Het Coordinated Framework for Regulation of Biotechnology regelt de bevoegdheidsverdeling. De US Department of Agriculture, de Environmental Protection Agency en de Food and Drug Administration zijn elk bevoegd voor een specifiek aspect van de regulering van GGO’s. Ze werken onderling samen. Hoewel er ook hier specifieke bepalingen voorzien zijn voor GGO’s, gaan de VS ervan uit dat GGO’s niet noodzakelijk een hoger risico vormen voor schadelijke gevolgen dan het “normaal” voedsel.

Zowel de Verenigde Staten als de Europese Unie stellen veiligheid voorop als het gaat over GGO’s. Toch is het beleid dat de VS voeren in vergelijking met dat van de EU over het algemeen minder streng. Eén verklaring alleen is onvoldoende om de verschillen tussen het beleid van de EU en de VS  te verduidelijken. Verschillende elementen spelen een rol en beïnvloeden elkaar onderling.

Zo oefenen de industriële sector en de landbouwsector grote druk uit op de regelgevers in de Verenigde Staten. Vanaf het begin van de ontwikkeling van de technologie hebben ze zich immers een belangrijke positie kunnen toe-eigenen binnen het regelgevend kader. Bovendien is de anti-GGO houding in de VS zwak en is het klein aantal fervente tegenstanders niet sterk genoeg georganiseerd om tegen de industriële sector te kunnen ingaan. Daarnaast vertrouwt de Amerikaanse consument erop dat de bevoegde organen en dan voornamelijk de Food and Drug Administration, voldoende controles uitoefenen op de veiligheid van het genetisch gemodificeerd product.

Daartegenover zijn de milieu- en consumentengroepen beter georganiseerd in de Europese Unie en oefenen zij grote druk uit op de beleidsmakers. Producenten zien zich genoodzaakt aan te sluiten bij de sterke publieke anti-GGO houding. Nog voor genetisch gemodificeerde producten op de markt werden gebracht, was de publieke opinie immers al sterk gekant tegen het gebruik ervan. Deze anti-GGO houding weerhield de industriële en de landbouwsector er nog meer van te pleiten voor een soepel kader voor het gebruik van GGO’s. Daarnaast mogen de voedselcrisissen op het einde van de jaren ’90, zoals de dioxinecrisis in België en de gekkekoeienziekte in Groot-Brittannië, niet vergeten worden. Deze crisissen vonden plaats op hetzelfde moment als de eerste GGO’s op de markt werden gebracht. De media-aandacht daaromtrent versterkte nog meer het reeds aanwezige wantrouwen van het publiek ten opzichte van de Europese regelgevers.

Er bestaat dus geen eenduidige reden waarom het beleid omtrent GGO’s in de Europese Unie zo verschilt van dat in de Verenigde Staten. Wel staat vast dat de verschillen tussen beiden tot spanningen leiden in de internationale handel. Zo verwijten ze elkaar de bepalingen van de Wereldhandelsorganisatie te schenden onder het mom van de bescherming van het milieu of de gezondheid. Als gevolg van de moeilijkheden binnen de Wereldhandelsorganisatie zijn onderhandelingen over een handelsakkoord tussen de EU en de VS begonnen in de zomer van 2013, maar deze zijn nog steeds niet afgerond. Er is intussen immers al veel kritiek gekomen op dit toekomstig Transatlantic Trade and Investment Partnership.

Genetisch gemodificeerde organismen, de ene vindt het briljant, de andere hekserij. Prince Charles of Wales beschuldigt wetenschappers ervan zich te begeven in “realms that belong to God, and to God alone”. Of toch maar atheïst worden dan?
