Gacaca: de Rwandese Schreeuw voor een op maat gemaakte justitie

Bemiddeling door lekenrechters na een genocide: Net een brug te ver?

 
Rwanda wordt wel eens het land van 'the thousand hills' genoemd, maar de meesten onder ons kennen Rwanda wellicht door haar genocide in 1994. Een gruwelijke afslachting van 800.000 onschuldige tutsi door "een bende losgeslagen barbaarse hutu", wordt wel eens gezegd, al is dat natuurlijk iets te ongenuanceerd. Niemand weet hoe hij of zij zou gereageerd hebben in die situatie. Het vermogen tot wreedheden is in elk van ons aanwezig. Wie in zijn eigen goedheid gelooft, heeft alleen maar het geluk gehad nooit te zijn blootgesteld aan die omstandigheden die het kwaad in ons wakker maken, schrijft Jan De Laender. Oorlog verandert de menselijke natuur. De wreedheden van de oorlog worden zelden bedreven door abnormale mensen. De tragedie van oorlog is net dat de barbaarsheden worden begaan door normale mensen in abnormale omstandigheden.
 
Na haar genocide staat Rwanda voor de enorme uitdaging om de daders te berechten. Al snel wordt duidelijk dat dit niet zal kunnen op een manier zoals we dat in België kennen. Behoudens de vaststelling dat het Rwandese gerechtelijke apparaat al van lang voor de genocide geen goed geoliede machine was, is er de oneindig lijkende lijst van daders. Een kleine berekening wijst uit dat het minstens 109 jaar zou duren vooraleer de laatste dader berecht is. Onze gerechtelijke achterstand is er niets tegen. Een punitief systeem zoals het onze, waar de nadruk ligt op het straffen van de dader via een uitgebreid proces, is duidelijk geen optie.
 
In haar zoektocht naar een alternatief, vindt de Rwandese overheid inspiratie in een traditionele manier van geschillenbeslechting. Gacaca (wat je uitspreekt als ga-chá-cha) is het Rwandese woord voor gras, en verwijst naar bijeenkomsten van weleer, waar de hele gemeenschap samen kwam om over problemen te praten met als doel door bemiddeling de partijen terug met elkaar te verzoenen. Het waren de dorpswijzen die alles in goede banen leidden en eindverantwoordelijken waren voor het beslechten van het geschil. Deze aanpak zou vandaag "restauratieve justitie" genoemd worden, omdat het erop gericht is de relatie tussen beide partijen en de rust in de gemeenschap te herstellen.
Restauratieve justitie wordt in België doorgaans gebruikt bij minder zware feiten, en is vooral populair bij minderjarige daders. Aanhangers van restauratieve justitie trokken dan ook grote ogen bij de idee om een vorm van bemiddeling te gebruiken voor misdrijven als genocide.
 
Aangezien genocide bekeken wordt als het érgste misdrijf van alle misdrijven, is het voor Rwanda ook geen optie om op een zuiver restauratieve, bemiddelende manier te werk te gaan. Er moesten minstens zware gevangenisstraffen opgelegd worden, om het signaal te geven dat genocide de misdaad der misdaden is, klonk het.
 
Rwanda krijgt de bijna onmogelijke taak om een systeem te bedenken dat straffen kan opleggen (punitief is) maar ook realistisch en uitvoerbaar is (dus snel kan werken) en tegelijkertijd ook rekening houdt met de oude Rwandese manier van bemiddelen (ook restauratieve kenmerken heeft).
 
Na jaren sleutelen zien de Gacaca Rechtbanken het levenslicht. Al gauw zeggen critici dat de Gacaca Rechtbanken een ongezonde mix zijn van verschillende systemen en gedoemd zijn te mislukken. Het is een gevaarlijk experiment waardoor de spanningen in het land enkel zullen stijgen, zeggen anderen.
 
Wendy De Bondt, licentiate in de rechten en in de criminologie, schreef haar scriptie over die Gacaca Rechtbanken. Alles kan beter, ook de Gacaca Rechtbanken. Hoewel de scriptie eindigt met een hele reeks aanbevelingen, hoort men volgens haar bewondering te hebben voor de creativiteit en de gedrevenheid die aan de dag gelegd wordt om van Rwanda weer een leefbare samenleving te maken. Haar werk doet besluiten dat de kritiek zeker niet altijd terecht is, en vooral niet genoeg rekening houdt met de specifieke Rwandese context. Men vraagt zich te weinig af wat de Rwandese bevolking nu zelf eigenlijk wil.
 
Het is cruciaal zich de vraag te blijven stellen wat men voor de slachtoffers kan doen eerder dan te blijven piekeren over wat men met de daders kan doen. De restauratieve kant van het verhaal en de noden van het slachtoffer moeten het centrale uitgangspunt blijven. Hoewel het verleidelijk is om te stellen dat de daders van de genocide allemaal levenslang de tralies achter moete, is dat praktisch nu eenmaal niet mogelijk door een gebrek aan voldoende gevangenissen en vanuit een economisch oogpunt niet realistisch. Een financiële investering ter uitbreiding van het gevangeniswezen is niet alleen onmogelijk, maar ook alles behalve wenselijk: de schaarse geldelijke middelen moeten in de eerste plaats gaan naar de wederopbouw van het land en de financiële ondersteuning van de slachtoffers.
 
Het is ook wel heel makkelijk om te zeggen dat het een slecht systeem is, omdat bijvoorbeeld de rechten van de verdediging onvoldoende gewaarborgd worden.
Een veel gehoorde kritiek handelt over de gebrekkige competentie van de gacaca rechters. Geconfronteerd met een gebrek aan geschoolde rechters, werd er bij het heruitvinden van de traditionele gacaca voor gekozen om de dorpswijzen te vervangen door verkozen lekenrechters, mensen zonder enige vorm van juridische training. Onderzoek wijst echter uit dat er geen enkele reden is om aan te nemen dat een eerlijk proces enkel bereikt kan worden voor lang en hoog geschoolde rechters. Aangezien de gacaca rechters verkozen zijn door de gemeenschap, vertegenwoordigen ze de democratische wil van de bevolking en vormt hun menselijkheid, soepelheid en afwezigheid van een strak juridisch zwart-wit denken net de kracht van de gacaca rechtbanken. De bevolking heeft het gevoel veel nauwer bij de processen betrokken te worden. Om het gebrek aan scholing op te vangen, heeft men wetgeving geschreven die bedoeld is om gebruikt te worden door mensen zonder juridische achtergrond. Daarnaast wordt voorzien in trainings- en opfrissingscursussen en wordt er een uitgeschreven handleiding ter beschikking gesteld.
De eerlijkheid gebied om eraan toe te voegen dat de uitvoering beter kan: de wetten hadden nog veel eenvoudiger gekund, men heeft de wetswijzigingen nooit geconsolideerd, waardoor de rechters met verschillende teksten moeten werken, en aangezien de handleiding niet meer geüpdate werd, is ze door die wetswijzigingen verouderd.
 
Toch verdient dit alternatieve systeem van geschillenbeslechting veel meer krediet en bewondering dat het tot nu toe gekregen heeft.
