De straffeloosheid bij VN blauwhelmen voor seksuele uitbuiting en misbruik – De huidige tekortkomingen en de nood aan hervormingen

De Verenigde Naties werden in het leven geroepen met als doel de internationale vrede en veiligheid te bevorderen. Één van de instrumenten die het voorhanden heeft ter verwezenlijking van deze doelstelling is peacekeeping of vredeshandhaving. Door middel van vredeshandhavingsoperaties waarbij VN blauwhelmen worden ingezet, tracht men de vrede in conflictgebieden te behouden of te herstellen. Ondanks de positieve doelstelling die vooropstaat, kent vredeshandhaving evenwel ook een keerzijde. VN blauwhelmen worden in toenemende mate in verband gebracht met seksuele uitbuiting en misbruik ten aanzien van de kwetsbare bevolkingsgroepen die zij moeten beschermen.

VN blauwhelmen en seksuele uitbuiting en misbruik

In de media doken reeds talloze berichten op die het seksueel wangedrag in hoofde van VN blauwhelmen aan het licht brachten. De eerste aantijgingen dateren van de jaren ’90 in het kader van de vredesoperatie in Cambodia maar werden al snel opgevolgd door gelijkaardige aantijgingen gedurende latere missies zoals in Haïti en de Democratische Republiek Congo. De praktijken variëren van verkrachting en prostitutie tot kindermisbruik. Minderjarige meisjes verkopen bijvoorbeeld hun lichaam in ruil voor slechts enkele dollars of blauwhelmen maken zich schuldig aan groepsverkrachtingen ten aanzien van de lokale bevolking.

Ondanks het nultolerantiebeleid van de VN en diens maatregelen om seksuele uitbuiting en misbruik in het kader van vredeshandhavingsoperaties tegen te gaan, doen dergelijke praktijken zich drie decennia later nog steeds voor. In 2016 bereikte het aantal beschuldigingen van seksueel wangedrag zelfs opnieuw een hoogtepunt. Één van de oorzaken waardoor seksuele uitbuiting en misbruik in hoofde van VN blauwhelmen zich nog steeds voordoet, is de straffeloosheid die ermee gepaard gaat. De praktijken blijven veelal onbestraft en de daders gaan vrijuit. Hierdoor heerst binnen de contingent de opvatting dat men onverminderd kan doorgaan met de praktijken.

Een cultuur van straffeloosheid - Oorzaken

Het juridische kader inzake de strafrechtelijke aansprakelijkheid van VN blauwhelmen stoot op enkele moeilijkheden die verhinderen dat vredeshandhavers berecht worden voor hun wangedrag. Zowel de klachten- en onderzoeksprocedure, als de vervolgingsprocedure kampen met tekortkomingen. Vele misbruiken worden bijvoorbeeld niet gerapporteerd, onderzoeken vertonen een gebrek aan transparantie en de procedures nemen te veel tijd in beslag. Dit zijn evenwel slechts enkele aspecten die de berechting van VN blauwhelmen voor seksueel wangedrag bemoeilijken.

Het meest problematische aspect is de afhankelijkheid van de staten die de militaire eenheden ter beschikking van de VN stellen, ook wel zendstaten genoemd. Aan de zendstaten wordt de exclusieve jurisdictie inzake de vervolging van hun eigen eenheden toegekend. Dit betekent dat de berechting van VN blauwhelmen volledig in handen ligt van de zendstaat en diens bereidheid om op te treden ten aanzien van zijn eigen troepen. Treedt de zendstaat niet op, dan gaat de dader vrijuit.

Optreden van de zendstaat blijkt evenwel eerder de uitzondering op de regel. Naast procedurele hinderpalen zoals de moeilijkheden die gepaard gaan met het verrichten van een onderzoek naar feiten gepleegd in het buitenland, zijn zendstaten in eerste instantie terughoudend om eigen militairen te berechten. In dat geval worden zij immers geassocieerd met de praktijken die hun reputatie negatief zouden beïnvloeden.

Resolutie 2272

Om zendstaten ertoe aan te zetten hun contingenten in toom te houden en hun troepen te bestraffen, vaardigde de VN Veiligheidsraad op 11 maart 2016 Resolutie 2272 uit. De Resolutie ontneemt de exclusieve jurisdictie van de zendstaat niet maar hoopt wel door middel van de repatriëring van een nationale contingent de zendstaat onder druk te zetten zijn verantwoordelijkheden op te nemen en bijgevolg zijn troepen te disciplineren en berechten. Laat de zendstaat na de vermeende feiten te onderzoeken of te vervolgen, dan kan de Secretaris-Generaal de volledige eenheid van de zendstaat naar huis sturen. Ook wanneer er sprake is van wijdverspreide seksuele uitbuiting en misbruik door eenzelfde eenheid zal die eenheid worden gerepatrieerd. Op die manier verhindert men dat de troepen in kwestie nog meer slachtoffers maken en worden zendstaten mogelijks ijveriger hun troepen te disciplineren en te bestraffen.

Doch kampt ook de Resolutie met enkele tekortkomingen die de implementatie kunnen beïnvloeden. De Resolutie bevat bijvoorbeeld vage bewoordingen, stoot op de kritiek dat een volledige eenheid bestraft wordt voor het gedrag van enkelen en de haalbaarheid om een contingent te vervangen wordt in vraag gesteld. De belangrijkste tekortkoming is evenwel dat de Resolutie niet garandeert dat naderhand wel berecht wordt. Wordt een eenheid naar huis gestuurd, dan betekent dit niet dat de zendstaat de daders alsnog zal bestraffen. Bijgevolg volstaat Resolutie 2272 niet om een einde te maken aan de straffeloosheid.

Naar een toekomst met effectieve bestraffing

Om blauwhelmen in de toekomst niet langer vrijuit te laten gaan, zijn hervormingen vereist. Naast maatregelen ter bevordering van de rapportage, is het van groot belang dat men ingrijpt in de jurisdictie die momenteel exclusief toekomt aan de zendstaat. Het niet-optreden van zendstaten vormt immers de voornaamste oorzaak van de huidige straffeloosheid. Deze bevoegdheid, alsook de bevoegdheid inzake het ontvangen van klachten en het voeren van het onderzoek, dient toe te komen aan één onafhankelijke instantie.

In mijn onderzoek komen twee alternatieve fora aan bod. Enerzijds hybride tribunalen in de ontvangststaat. Dit zijn nationale rechtbanken die als het ware geïnternationaliseerd worden. En anderzijds een nieuw permanent hof met jurisdictie inzake ernstig wangedrag van VN vredespersoneel. Hoewel beide fora volwaardige alternatieven zijn, stoten beide evenwel op hetzelfde probleem. Zendstaten moeten instemmen met de afname van hun exclusieve jurisdictie en daar wringt het schoentje. Toch is een dergelijke maatregel vereist om de straffeloosheid een halt toe te roepen.

Conclusie

Niettemin de VN reeds verschillende initiatieven namen om seksuele uitbuiting en misbruik door VN blauwhelmen te bestrijden, duiken aantijgingen van seksueel wangedrag door vredestroepen ook vandaag nog op. Dit wijst erop dat initiatieven zoals Resolutie 2272 niet afdoende zijn om een einde te maken aan het wangedrag en de bijhorende straffeloosheid. Wil de VN van VN vredeshandhaving opnieuw zijn paradepaardje maken, dan dient het het huidige juridische kader grondig te hervormen om een einde te maken aan de wanpraktijken en de straffeloosheid die elkaar momenteel in de hand werken.
